If someone breaks the ladders, and staff saw it, and they get kicked... But what if another player didnt break the ladders and jumped down (ex. http://imgur.com/KvtFI1Z ) are you still able to get kicked?

I believe so. You get the punishment for exploiting it I believe. So even if you didn't take down the ladders, you are still exploiting it by doing this.
Yes, even if you didn't specifically make the glitch happen, you're still taking place in it. Whether you're going after a murderer with the is another story.
