Not getting gun in murder?

Do you mean spawn with it or when you collect 5/6 emeralds your inventory doesn't update to give you it?

Have you shot loads of people before? Or do you have low karma? :p
 
If you don't get it when you spawn, you're either very unlucky, or have low/negative karma.
It's just a case of time.
